Terms of Service

Last updated: March 4, 2026

These Terms of Service ("Terms") govern your access to and use of the AlwaysPick platform, including our website at alwayspick.com, AI virtual receptionist services, dashboard, and related features (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Service Description

AlwaysPick is a cloud-based SaaS platform that provides AI-powered virtual receptionist capabilities for small businesses. The Service includes automated call answering, appointment scheduling, call analytics, CRM features, and optional live operator support. The Service is designed for businesses operating in the United States.

2. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old and have the authority to bind the business entity you represent. You agree to notify us immediately of any unauthorized access to your account.

3. Subscriptions and Billing

The Service is offered on a subscription basis with monthly billing. Pricing details are available on our pricing page. All payments are processed by Paddle.com, who acts as the Merchant of Record for all orders placed through AlwaysPick. Paddle handles payment processing, invoicing, sales tax calculation and remittance, and customer payment inquiries.

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through the dashboard. Cancellation takes effect at the end of the current billing period — you will retain access until then.

4. Free Trial

New accounts receive a 7-day free trial of the Professional plan. No payment information is required to start a trial. At the end of the trial period, you may choose a paid plan to continue using the Service.

5. Acceptable Use

You agree not to use the Service for any unlawful purpose, to transmit harmful or malicious content, to interfere with the Service's operation, to attempt unauthorized access to other accounts or systems, or to use the Service for automated telemarketing or spam calls. We reserve the right to suspend or terminate accounts that violate these terms.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data and the data of your callers. You are responsible for ensuring that your use of the Service complies with applicable privacy and telecommunications laws in your jurisdiction.

7. Intellectual Property

The Service, including its software, design, and documentation, is the intellectual property of AlwaysPick. You retain ownership of the data you provide to the Service, including business information, client records, and call recordings. We do not claim ownership of your content.

8. Service Availability

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.

9. Limitation of Liability

To the maximum extent permitted by law, AlwaysPick shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these Terms or if required by law. You may terminate your account at any time by cancelling your subscription and contacting support. Upon termination, your data will be retained for 30 days before permanent deletion, unless you request earlier deletion.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the dashboard. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Payment Processing

Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. All payment-related questions, disputes, and refund requests should be directed to Paddle or to our support team at [email protected].

13. Contact
